Terms of Service

1. Acceptance of Terms

By accessing or using DwellerHQ's platform and services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Services. These Terms apply to all users of the platform, including strata managers, residents, board members, and administrators.

2. Description of Services

DwellerHQ provides a cloud-based strata management platform designed for property management in the Caribbean. Services include but are not limited to: dues collection, invoice management, resident portals, financial reporting, maintenance request management, document management, AGM and voting tools, and compliance tracking.

3. User Accounts

To use certain features of the Services, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify DwellerHQ immediately of any unauthorized use of your account. DwellerHQ reserves the right to suspend or terminate accounts that violate these Terms.

4. Subscription & Payment Terms

DwellerHQ is offered on a monthly subscription basis. New strata corporations receive a 14-day free trial with full access to the Pro tier; no payment information is required to start the trial. After the trial, continued access requires an active subscription to one of the published plans (Lite, Standard, or Pro), billed monthly in U.S. dollars. Subscription fees are processed by Stripe, our payment processor; DwellerHQ does not store full payment card details. Plans may be upgraded, downgraded, or cancelled at any time through the in-app billing portal. DwellerHQ reserves the right to adjust pricing or plan features with reasonable advance notice.

Where DwellerHQ facilitates payments from residents to a strata corporation, additional transaction fees may apply. Such fees, where applicable, are disclosed in the strata corporation's account settings prior to enabling resident-payment collection.

5. Acceptable Use

You agree to use the Services only for lawful purposes and in accordance with these Terms. You may not use the Services to transmit harmful, fraudulent, or illegal content; attempt to gain unauthorized access to the platform or other accounts; interfere with the proper functioning of the Services; or violate any applicable local, national, or international law.

6. Intellectual Property

The Services and all associated content, features, and functionality are owned by DwellerHQ and are protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Services for their intended purpose. You may not copy, modify, distribute, or create derivative works based on the Services without prior written consent.

7. Data and Privacy

Your use of the Services is also governed by our Privacy Policy. By using the Services, you consent to the collection and use of information as described in the Privacy Policy. You retain ownership of all data you input into the platform, and DwellerHQ acts as a data processor on your behalf.

8. Limitation of Liability

To the fullest extent permitted by law, DwellerHQ shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Services. DwellerHQ's total liability shall not exceed the total fees paid by you in the twelve (12) months preceding the claim.

9. Termination

Either party may terminate the use of Services at any time. Upon termination, your right to access the platform will cease. DwellerHQ will provide reasonable assistance in exporting your data upon request. Sections of these Terms that by their nature should survive termination will remain in effect.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Jamaica, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Jamaica.
